Este artículo analiza -desde un enfoque exploratorio y descriptivo- el impacto del Decreto de Necesidad y Urgencia (DNU) 70/2023 emitido por Javier Milei en el ámbito del derecho a la salud en Argentina. Se analizan las modificaciones introducidas en los mecanis-mos de control de precios de las cuotas de las obras sociales y empresas de medicina prepaga, así como los mecanismos legales que se promovieron para detener su imple-mentación. A partir del análisis de fuentes normativas, jurisprudenciales y bibliográficas, se advierte que las medidas adoptadas avanzan hacia una mercantilización del sistema sanitario bajo el argumento de resolver la crisis económica del sector, lo que tensiona la garantía de acceso a la salud. En este marco, la intervención judicial funciona como un contrapeso que reafirma la salud como un derecho y la obligación indelegable del Estado de garantizarlo.
This paper analyzes—from an exploratory and descriptive perspective—the impact of Decree of Necessity and Urgency (DNU) 70/2023, issued by Javier Milei, on the right to health in Argentina. It examines the modifications introduced to the price control mechanisms for social security and private health insurance premiums, as well as the legal mechanisms promoted to halt its implementation. Based on an analysis of regulatory, jurisprudential, and bibliographic sources, it is observed that the measures adopted advance the commodification of the healthcare system under the pretext of resolving the sector's economic crisis, thereby straining the guarantee of access to healthcare. In this context, judicial intervention acts as a counterweight, reaffirming health as a right and the State's non-delegable obligation to guarantee it.
