Las Causas matrimoniales en la justicia civil de Córdoba en la primera mitad del siglo XIX

La violencia contra las mujeres en el seno de la vida conyugal ha sido analizada por la historiografía en gran medida a partir de reservorios documentales eclesiásticos donde se alojan estas causas matrimoniales. En este sentido, la curia diocesana a través de los tribunales eclesiásticos ordinarios recibía las solicitudes de divorcio de mujeres. No obstante, existen en la jurisdicción cordobesa y para el mismo periodo, expedientes con denuncias de mujeres hacia sus maridos por malos tratamientos pero que fueron presentadas en tribunales seculares. Este trabajo explora la actuación de los agentes de justicia secular en causas matrimoniales, materia ésta comprendida como “exclusividad” de la Iglesia entre finales del siglo XVIII y la primera mitad del siglo XIX en Córdoba.
Violence against women in conjugal life has been analyzed by historiography to a large extent on the basis of ecclesiastical documentary reservoirs where these files are lodged. In this sense, during the 18th century and most of the 19th century, the diocesan curia, through the ordinary ecclesiastical courts, received women's requests for divorce. However, in the Cordoba jurisdiction and for the same period, there are files with complaints by women against their husbands for ill-treatment but which were presented in secular courts. This paper explores the actions of secular justice agents in matrimonial cases, a matter understood as “exclusive” to the Church between the end of the eighteenth century and the first half of the nineteenth century in Cordoba.
