Luces y sombras en torno al concepto de dignidad fenomenológico-moral: un análisis jurisprudencial

El objetivo de este artículo consiste en analizar la concepción de la dignidad a la que se adhieren la Corte Suprema de Justicia de la Nación Argentina y el Tribunal Constitucional Español, a partir de una serie de fallos vinculados con el bien jurídico vida. En la doctrina es posible identificar dos concepciones básicas: una de carácter ontológico, centrada en el ser, y otra de carácter moral, centrada en los hechos. Como se expondrá, ambos órganos judiciales emplean el concepto sin diferenciarlas. No obstante, podrá advertirse una fuerte tendencia hacia la dignidad fenomenológico-moral, no exenta de críticas.
The aim of this article is to analyze the concept of dignity upheld by the Supreme Court of Justice of the Argentine Nation and the Spanish Constitutional Court, based on a series of rulings related to the legal good of life. In the doctrine, two basic conceptions can be identified: one of an ontological nature, focused on being, and the other of a moral nature, focused on facts. As will be explained, both judicial tribunals use the concept without differentiating between the two conceptions. However, a strong tendency toward a phenomenological-moral dignity will be noted, which is not without criticism.
