Esta tesis tiene por objetivo identificar qué rol desempeña la digitalización dentro la empresa agraria esencialmente porque dicho elemento constituye un nuevo paradigma de producción sostenible. Luego de un análisis pormenorizado de la evolución histórica y doctrinaria de la empresa agraria, arribé a la conclusión, siguiendo la doctrina del Dr. Raúl Mugaburu, que el elemento digital es un bien inmaterial intangible que integra la hacienda como capital auxiliar. Así mismo, corresponde ponderar que la digitalización constituye un nuevo requisito convirtiéndose en el quinto elemento que caracteriza a la empresa agraria moderna del siglo XXI conjuntamente con los elementos de economicidad, profesionalidad, organicidad e imputabilidad. Consecuentemente, el derecho agrario actual se encuentra impactado transversalmente con la incorporación del elemento digital que lo redimensiona potenciando su rendimiento, agregando valor a la producción agropecuaria y garantizando la seguridad alimentaria a largo plazo adaptándolo a las nuevas necesidades que exige la economía con fines de mercado. Como corolario, ante la falta de una regulación legal que lo normativice y con el fin de resguardar la naturaleza de lo agrario, comparto la postura del Dr. Ricardo Zeledón Zeledón quien anexa el aspecto axiológico para que la actividad agraria digital se desarrolle asegurando el desarrollo rural, el uso sostenible de los recursos y la solución equitativa de los conflictos.
This thesis aims to identify the role of digitalization within agricultural enterprises, essentially because this element constitutes a new paradigm of sustainable production. After a detailed analysis of the historical and doctrinal evolution of agricultural enterprises, I concluded, following the doctrine of Dr. Raul Mugaburu, that the digital element is an intangible asset that integrates the farm as auxiliary capital. Likewise, it is important to consider that digitalization constitutes a new requirement, becoming the fifth element that characterizes the modern agricultural enterprise of the 21 st century, along with the elements of economy, professionalism, organic structure, and accountability. Consequently, current agricultural law is being impacted across the board by the incorporation of the digital element, which redefines it, enhancing its performance, adding value to agricultural production, and guaranteeing long- term food security by adapting it to the new needs of the market-driven economy. As a corollary, given the lack of legal regulation governing it and in order to safeguard the nature of agriculture, I share the position of Dr. Ricardo Zeledon Zeledon, who adds the axiological aspect so that digital agricultural activity can develop while ensuring rural development, the sustainable use of resources, and equitable resolution of conflicts.
